A refusal or cancellation is not always the end. Many decisions can be reviewed at the Administrative Review Tribunal (ART), and some can go to court. Act quickly: deadlines are strict.
Time limits apply.
Review deadlines are strict and some are only a few days. Late applications usually can’t be accepted. Check your decision letter today and call us.
How we help
We check your review rights, lodge on time and build the strongest case we can. If the tribunal decision contains a legal error, our solicitor can take it to court, so you don’t have to start again with someone new.
Our professional fees are set out in writing in a Client Service Agreement before we start. Government visa application charges are set by the Department of Home Affairs and change each year. We give you a full estimate at your consultation. You can also check the official visa fees and charges.
Frequently asked questions
The Administrative Review Tribunal reviews many government decisions, including most visa refusals and cancellations. It replaced the Administrative Appeals Tribunal (AAT) on 14 October 2024. The ART looks at your case again on its merits and can consider new information.
It depends on the decision and where you are. Time limits range from 7 working days (for example, for people in immigration detention) to 28 days, depending on the decision. Your decision letter states the deadline. Contact us immediately so we can confirm it.
Often, yes, if you hold a bridging visa. We check your visa status as a first step and advise on any conditions, including work rights.
If the ART decision contains a legal error, you may be able to apply to the Federal Circuit and Family Court for judicial review. The court doesn’t decide whether you should get the visa; it decides whether the decision was made lawfully. There is a strict time limit, generally 35 days from the ART decision.
You can represent yourself, but judicial review is technical and the rules are strict. Our solicitor can act for you in court, working with barristers where needed.
Your decision letter, the date you received it and how it was sent, your current visa details, and your original application and documents.
The ART charges an application fee, and there are professional fees for preparing your case. We give you a written estimate before we start.
